Liability + Warranty Policy

Liability

1. Scope of Liability


Fixit Maintenance (The Company) is responsible for ensuring that all services are performed in a professional and workmanlike manner, in accordance with industry standards and applicable laws. The company will be liable for any damage to the client’s property caused directly by the negligence, wrongful act, or omission of its employees or subcontractors during the performance of the services.

2. Exclusions from Liability


The company will not be liable for:

  • Pre-existing conditions or damage not identified prior to service commencement.
  • Damage caused by factors beyond the company’s control, including but not limited to, natural disasters, acts of vandalism, or unauthorised alterations made by third parties.
  • Issues arising from incorrect use or improper maintenance by the client after services are completed.

3 Liability Limitations

The company’s liability for any claims, losses, or damages arising from its services will be limited to the total amount paid by the client for the specific service or project in question. The company will not be liable for any indirect, consequential, or incidental damages.

4. Indemnification


The client agrees to indemnify and hold harmless the company from any third-party claims, damages, losses, or expenses that arise due to the client’s actions, misuse of services, or failure to follow the company’s instructions or recommendations.

Warranty

1. Warranty on Workmanship


The company offers a warranty on workmanship for a period of 3 months from the date of completion of the service. If any issues arise during the warranty period due to faulty workmanship, the company will correct the issue at no additional cost to the client.

2. Warranty on Materials and Parts


For any materials or parts supplied and installed by the company, the warranty period is 1 year depending on supplier or as provided by the manufacturer, whichever is longer. The company will facilitate the replacement or repair of defective materials or parts covered under this warranty, though the client may need to return the defective parts to the manufacturer for resolution in some cases.

3. Exclusions from Warranty


The warranty does not cover:

  • Damage or issues caused by the client’s misuse, neglect, or failure to maintain the property after the service has been completed.
  • Normal wear and tear or issues arising from environmental factors like water damage, ageing, or pest infestations.
  • Any work carried out by third-party contractors or unapproved alterations to the property after the maintenance has been completed.
  • Electrical and Plumbing fittings not covered by any Warranty.

4. Claims Procedure


To make a warranty claim, the client must notify the company in writing within 7 days of discovering the issue. The company will inspect the situation and determine whether the issue is covered under warranty. If covered, the company will make the necessary repairs or replacements free of charge.

5. Limitation of Warranty


This warranty is the sole and exclusive remedy for any issues arising from the company’s services. The company’s responsibility under this warranty is limited to repair or replacement of the defective workmanship or materials, and no further claims will be entertained.

By engaging in services with Fixit Maintenance, the client agrees to the terms and conditions as outlined above.
